BMC-35 trucking insurance cancellations: a guide for agents

A BMC-35 is the insurer's notice to FMCSA that it is cancelling a carrier's liability filing. The cancellation takes effect no sooner than 30 days after FMCSA receives the notice. If the carrier has no replacement filing in place by then, it can lose its operating authority, so a carrier with a cancellation notice has a dated reason to talk to another agent.

What a BMC-35 cancellation notice is

When an insurer stops covering a carrier (non-payment, a change in risk, the carrier moving its business), it files Form BMC-35 with FMCSA. Under 49 CFR 387.313(d), the filing can't be cancelled until 30 days after FMCSA receives that notice. The notice is public and carries the effective date.

What happens on the effective date

If a new insurer has filed a replacement BMC-91 or BMC-91X before the effective date, nothing changes for the carrier. If not, FMCSA can revoke the operating authority for lack of insurance, and the carrier can't haul for hire until it's reinstated. CarrierDaily lists those as suspensions for lapsed insurance.

Why cancellations are the easiest close

How to work cancellation notices

  1. Pull the new notices every business day; the earliest calls get the conversation.
  2. Sort by days until the cancellation takes effect, soonest first.
  3. Skip carriers whose replacement filing is already on record.
  4. Lead with the date: "Your liability filing shows a cancellation effective on the 14th. Do you have a replacement in place?"

CarrierDaily lists carriers whose liability insurance was just cancelled, with the former insurer and the days left until it takes effect. See recent cancellations near you, or read the agent overview.

Questions

How much notice does an insurer give before cancelling a trucking filing?

At least 30 days. Under 49 CFR 387.313(d), the filing can't be cancelled until 30 days after FMCSA receives the insurer's notice on Form BMC-35.

Does a BMC-35 mean the carrier has no insurance?

Not yet. It's a notice with an effective date, often still ahead. The carrier stays covered until then and keeps its authority if a replacement filing is on record in time.

Where can I find trucking insurance cancellation notices?

They're in FMCSA's public insurance data (the L&I system and its open datasets). CarrierDaily publishes them daily with the former insurer and the days until the cancellation takes effect.
